In an affidavit, submitted to the Court on 22 October, the business lobby group, Sakeliga, requests that, should the Minister of Health succeed in pausing the constitutional challenges against the NHI Act, the Court must “simultaneously interdict the State from implementing any part of the NHI Act”. – Business Day (23 October 2025)
This follows Minister Motsoaledi’s application in August, requesting the Court to consolidate all existing High Court cases and to suspend all challenges related to the Act's constitutional validity.
“Sakeliga warned that a successful stay application by the Minister would suspend all judicial scrutiny of the NHI Act, allowing Government to proceed with implementing the Act.”
