Ramaphosa applied for leave to appeal High Court judgement on NHI Act

04 Jun 2025

On 2 June the President Cyril Ramaphosa has applied for leave to appeal against a High Court ruling concerning his decision to sign the NHI Act into law.
The decision dismisses a previous High Court judgment that had deemed the President's assent to the NHI Act reviewable and ordered him to furnish the court with the record of his decision. – Business Day (4 June 2025)
“The legal challenge against President Ramaphosa's assent was initially brought by the Board of Healthcare Funders (BHF), which represents medical schemes, and the SA Private Practitioners Forum (SAPPF), which represents specialists. Their successful High Court bid in May had placed the President's decision under scrutiny.”
However, President Ramaphosa's legal counsel argued that assent to and signature of a bill are obligations that lie exclusively with the President, as per sections 79(1) and 84(2) of the Constitution.
