Legal challenges threaten Universal Healthcare

Finance Minister Enoch Godongwana recently proposed in Parliament that the nine ongoing NHI legal challenges be withdrawn, suggesting stakeholders sit down for constructive negotiations, wrote Steven Grootes in Daily Maverick (18 Jan 2026).
“Negotiations offer a potential route forward, especially given that many of the core disputes boil down to financial considerations. From emergency care to chronic illnesses, the crux for many private players is funding. There's a window for common ground - but also significant resistance.
“To some, Godongwana’s call for a truce is a sign that the Government knows it may not prevail in Court. But to others it is a chance to pause hostilities and explore practical solutions - at least temporarily.”
In the past mostFinance Ministers distanced themselves from the NHI plan.
Meanwhile, the funding gap remains the most significant vulnerability and the ANC has yet to offer a clear explanation of how the NHI would be sustainably funded.
Some opponents of the NHI argue that the Act is unconstitutional.
“Even if negotiations go ahead, legal action remains an option for these groups should talks break down. Ultimately, the future of the NHI legal challenges rests not just on law but also on politics,” wrote Grootes.
