MEDICAL MALPRACTICE FOR SPEECH THERAPISTS

January 2007

Dear SPEECH THERAPISTS & AUDIOLOGISTS

We are pleased to advise that we have negotiated with underwriters to include both products liability and public liability in your cover as from the renewal of your policy in 2007.

Type of coverLimit of indemnity Per claim deductible of
Public LiabilityR 1 000 000.00 R 5 000
Products LiabilityR 1 000 000.00R 10 000

Public liability:
Public Liability insurance indemnifies you for costs which you are legally liable to pay to a claimant due to bodily injury or damage to property happening in the course and scope of your practice. This cover excludes liability which should properly be covered under any other type of insurance, for example; car insurance, medical malpractice insurance or any liability which falls within the scope of mandatory legislated cover e.g. Workmen’s Compensation.

Examples of typical public liability type claims:
  1. Practice Premises; a patient slips and falls on your premises due to the floor being wet, a handrail being loose on the steps, etc.
  2. Away from Practice; you negligently damage an expensive piece of equipment at a hospital.
Products liability:

There may be instances when you are sued due to harm caused to a patient by a product which you either use in your practice e.g. Botox or which you make and/or sell e.g. special creams. Products liability cover will indemnify you for your legal defence costs and any awards made against you in such cases.

Please due not hesitate to contact us if you require any further clarification about these 2 additional covers.

Kind regards,
